PORT TO PEAK TRAVEL TERMS AND CONDITIONS applies from 25th May 2023:
Please carefully read the following information listed below as it contains important information pertaining to your booking with Port to Peak Travel.
By making any booking for travel products with Port to Peak Travel, you agree to comply with and be bound by these booking conditions, which apply to any bookings you make (in-store, over the phone or by email) as well as online bookings you make via our website. These Terms and Conditions govern Port to Peak Travel’s relationship with you. Once a booking is made with a supplier on your behalf, you will also enter into a separate contract with that supplier and be governed by their terms and conditions. It is your responsibility to make yourself aware of these additional Terms and Conditions. You should read all of the relevant Travel Provider Terms and Conditions before acquiring booking & advisory services from us.
TRAVEL AGENT RESPONSIBILITY:
Please note that Port to Peak Travel acts only as booking agent for airlines, cruise lines, hotels, wholesalers, tour operators and other travel service providers in booking travel arrangements on your behalf. Port to Peak Travel does not own or operate airlines, cruise lines, hotels or any other travel service provider and is not liable or responsible for: any accident, injury or health problems suffered by travellers; loss or theft of or damage to any personal possessions or property; delays, re-routing, cancellations or service deficiencies of any service; insolvency, business failure or grounding of an airline, cruise ship, hotel, or other service.
Port to Peak Travel recommends travel service providers based on product quality, needs and requests of our clients. We do not investigate or give any assurance about the financial condition or solvency of any service provider.
Port to Peak Travel staff, whilst often personally familiar with some properties and/or other travel services provided, cannot possibly be familiar with all properties and/or other travel services provided on offer. Therefore, Port to Peak Travel staff cannot personally offer guarantees on the quality of services or standards provided by the air/cruise line/hotel/wholesaler/tour operator or other travel service providers booked on your behalf. In making your booking, Port to Peak Travel has used information supplied by the hotels and/or other associated travel companies providing the various services.
Port to Peak Travel is acting solely as a booking agent for the respective companies and, in providing this information to you, Port to Peak Travel disclaims, and will be exempt from, any (whether as a matter of contract, tort, statute, restitution, or otherwise) for any direct, indirect or consequential loss, liability, claim, cost, expense, death, injury, illness, shock, inconvenience or delay.
You are solely responsible for the suitability of any travel product that you purchase. Port to Peak Travel is not liable for any inconvenience caused or expense incurred as a result of any unsuitability of the travel product, subject to your rights under the Australian Consumer Law. Port to Peak Travel will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking (regardless of whether other travellers have made separate payments) and that person will bind all such travellers to these Booking T&Cs and to the Travel Provider T&Cs.
Port to Peak Travel is not responsible for any cancellations caused by world events, unexpected disasters, global danger zones, Do Not Travel warnings, riots, strikes or similar events, epidemic or pandemic outbreaks, sanctions, prohibition or restrictions under United Nations Security Council or any sanctions or laws from any governing body.
GST:
At the time of printing, the Australian Tax Office has deemed that International Travel is GST FREE. Domestic Travel, if booked in conjunction with International, should also be GST FREE. Whilst, at this time, International Travel is not subject to GST, Port to Peak Travel reserves the right to impose a GST surcharge if the circumstances change prior to departure date.
FEES AND COMMISSIONS:
The below Schedule of Fees lists all the fees charged by us. These are in addition to any fees or non-refundable components charged by the Travel Providers (as detailed in their relevant Travel Provider T&Cs):

PAYMENTS:
Please refer to your individual booking invoice for details of when your final payment is required. Amounts and timelines vary from supplier to supplier. Port to Peak Travel reserves the right to set an earlier final payment than the supplier in order to allow payments to clear and process in advance of the supplier's deadline.

You can pay with credit card using the secure travel industry TravelPay system, simply click on the link below and action your card payment, alternatively call us and we will action the payment for you via TravelPay. These fees are subject to change and update. You authorise us to charge all fees incurred by you in relation to the products and/or services provided by us to the credit card or debit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand. In the case where credit card payment is provided directly to the supplier, different merchant fees may apply. We will advise you at the time of payment.

In the current economic climate, supplier insolvency is at a heightened risk.
PRICES:
Port to Peak Travel reserves the right to vary prices prior to final payment in the event of significant movements in foreign exchange rates, taxes, price increases from suppliers or for any other reason beyond its control. This may occur with or without notice to the traveller. NB: Listed prices do not imply that the same or similar product may or may not be available at a lower price if obtained via another source. The rates of accommodation and insurance are set to include the payment to suppliers, as well as costs of any/all; research, inspection, brochure preparation, printing and distribution, internet downloads, advertising, reservations, facsimile transmissions, telephone calls, postage, bank charges, currency transfers, documentation, courier fees and remuneration to booking agents. Receipt of your deposit signifies your acceptance of the price offered and acknowledgment of these normal commercial expenses.
DEPOSITS:
Please refer to your individual booking invoice for details of how much deposit is due and when payment is required. Amounts and timelines vary from supplier to supplier. These deposits may be non-refundable or subject to cancellation or amendment fees. Port to Peak Travel reserves the right to charge a $200.00 per person non-refundable deposit in addition to any that the suppliers require.
A deposit will generally secure your booking/seat; however, price changes may occur by reason of matters outside our control prior to you making the final payment. Prices are only guaranteed once your booking has been paid for in full.
AMENDMENTS:
If you wish to change a booking prior to final payment, Port to Peak Travel reserves the right to pass on any amendment fees charged by the airlines/cruise lines/hotels/wholesalers/tour operators or other travel service providers plus a standard travel amendment fee of (a minimum) $75.00 per person plus the amendment fees of each individual service provider. Amendments made after final payment may not be permitted by the supplier.
In the event of unavoidable or extraordinary circumstances, a travel service provider may materially modify or cancel your booking.
Unavoidable or extraordinary circumstances means any cause outside a travel service provider’s reasonable control which could not have been prevented or avoided even if all reasonable measures had been taken by the travel service provider.
CANCELLATIONS & REFUNDS:
In most instances, deposits are non-refundable and cancellation fees will be charged if you cancel or terminate your holiday earlier than expected, for whatever reason. Airline and cruise refunds make take up to 120 days or longer for processing. Refunds for cancelled bookings will not be paid to the client until the supplier funds have been received by Port to Peak Travel.
Port to Peak Travel will not provide you with a refund for any service fees charged if the booking does not go ahead.
PASSPORTS& VISAS:
To comply with the majority of countries regulations, your passport should be valid for a minimum six months after your planned date of return to Australia. Some countries require a machine-readable passport. For international travel bookings, you must let us know if you have less than 6 months validity on your passport or if you do not have a machine-readable passport. When assisting with an international travel booking, we will assume that all travellers on the booking have a valid Australian passport which is valid for the relevant destination and transit point. If this is not the case, you must let us know. It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent caused by fault on our part).
Port to Peak Travel does not assist with obtaining Visas, ESTAs or ETAs. We are happy to provide you with information pertaining to which countries on your journey will require visas and to direct you to consulates, embassies, official websites and visa services, but we are not able to process the visa applications for you.
We can provide you with general information only on visa and passport requirements that apply to international travel bookings you make with us. You can contact an external visa provider such as CIBT Visas (cibtvisas.com.au)) directly. We do not warrant the accuracy or suitability of information provided by any external service provider and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).
HEALTH:
Some countries have certain health requirements which must be met before you will be permitted to enter the country. For some parts of the world there are recommended precautions you should take. Please check with your doctor prior to departure or visit a Traveller’s Medical Centre.
In some cases, failure to present required vaccination documentation (e.g. proof of COVID-19 and/or Yellow Fever vaccination) may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. General health advice for the destination you wish to visit is also available from DFAT (see www.smartraveller.gov.au)
Government, airline and travel service provider COVID-19 travel requirements are subject to change without notice.
Before booking, regularly after booking, and immediately before you travel, ensure you check the latest Australian Federal Government’s travel requirements. Visit the Australian Department of Home Affairs website https://covid19.homeaffairs.gov.au/ for more information as international travel resumes, Australia and all other countries may implement measures which continuously change, including additional health and safety protocols in response to COVID-19 and new variants which may impact your travel.
We recommend that you contact the Department of Foreign Affairs and Trade (“DFAT”) or visit their website at www.smartraveller.gov.au for general travel advice, as well as specific advice (including safety alert levels) relating to the destination/s you wish to visit or transit through.
We strongly recommend that you regularly familiarise yourself with: the current status and updates to Australia's immigration and border arrangements during the COVID-19 outbreak and relevant airline requirements and government policies around passenger safety and border control, including any requirements for mandatory health declarations, use of face masks, entry permits, pre-approvals and the need to produce valid evidence meeting airline and border control requirements in relation to a negative COVID-19 test result and/or COVID-19 vaccination status for both transit and final destination passengers, unless you have valid evidence of an exemption. This information is subject to change without notice to you, and any such changes may require you to make applications, provide a vaccination exemption, and/or other amendments to your booking and/or travel plans, and which may involve waiting periods, so we recommend you update yourself in relation to the relevant airline and government policies for your transit and final destination at each of (i) the time of booking, (ii) regularly after booking and as you approach your travel date, and (iii) immediately prior to departure. If you do not meet the correct travel requirements (including for mandatory health declarations, use of face masks, entry permits, pre-approvals and valid evidence in relation to a negative COVID‑19 test result and/or COVID-19 vaccine status, unless you have valid evidence of an exemption) you will not be able to board the flight and you may be denied entry to or required to undertake quarantine (possibly at your expense) in your transit and/or final destination.
You acknowledge that you are choosing to travel at a time where you may be exposed to COVID-19. It is your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks. You acknowledge that your decision to travel is made based on your own consideration of this information, and you acknowledge and agree that you are aware of, and assume responsibility for, the risks associated with traveling at this time. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.
TRAVEL INSURANCE:
The Australian Department of Foreign Affairs & Trade strongly asks intending travellers to consider taking out travel insurance, in many instances it is in fact compulsory. Travellers without travel insurance are personally liable for covering any medical and associated costs they incur. The Australian Government will not pay for your medical treatment overseas or medical evacuation to Australia or a third country. Please refer to DFAT Travel Insurance for more information. Travel Insurance may protect you against cancellation fees if you cancel your holiday due to unforeseen (unavoidable) circumstances.
Your insurance protection should at least include cover for cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance. Evidence of such insurances should be produced to us on request. Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel. Port to Peak Travel considers it essential that you have adequate travel insurance cover for personal accident, loss of baggage and illness and can provide factual information and upon request, a quotation to you for travel insurance. For details of the services that travel insurers provide, It is your responsibility to read the travel insurer’s Financial Services Guide (“FSG”) / Product Disclosure Statement (“PDS”) and ensure the cover you decide upon is adequate for your needs.
DEPARTMENT OF FOREIGN AFFAIRS WARNINGS:
It is recommended that all Australian travellers register their personal details with the Department of Foreign Affairs prior to any international travel. For reasons of political unrest, acts of war or terrorism or natural disasters in certain parts of the world the Australian Government in conjunction with various other worldwide bodies may decide to issue a Government Travel Advisory warning to Australia passport holders not to travel to that country. In these instances, whilst travel to some countries is not advisable and some clauses of the travel insurance coverage may not apply, we appreciate that some clients may still need to travel to these areas. Port to Peak Travel is prepared to make these bookings on our clients' behalf, however we do so without responsibility or liability. Up-to-date information is available on the Department of Foreign Affairs website.
FREQUENT FLYER, HOTEL MEMBERSHIPS & SPECIAL REQUESTS:
Please advise Port to Peak Travel of your Frequent Flyer membership details for inclusion in your booking. We do
not offer advice on Frequent Flyer eligibility on flights that we advertise or that you have booked. For more
information on whether your airfare is eligible for Frequent Flyer rewards, you must contact the Travel
Provider directly. We do not take any responsibility should a Travel Provider fail to register your trip. We
recommend that you retain copies of your airline ticket and boarding pass as a record. We will communicate any special requests that you have in relation to your Travel Product(s) but we make no guarantee that the Travel Provider will accommodate them.
PRIVACY:
You acknowledge and agree that we may disclose some or all of your personal information as outlined in our
Privacy Policy. A copy of our Privacy Policy will be forwarded to you in conjunction with our T&Cs at time of booking.
YOUR OBLIGATIONS AND WARRANTIES
You warrant and acknowledge to us that:
you are at least eighteen (18) years old and have the power, capacity and authority to enter into a binding contract with us and the Provider.
you have sufficient funds to pay for the Booking & Advisory Services and the Travel Product;
you have read and understood these T&Cs and if booking on behalf of third parties, you understand that their booking is subject to these same T&Cs and all relevant Travel Provider T&Cs
the information you provide us about you and third parties is true, accurate, current and complete (apart from any optional items) as required by any registration process.
you will maintain and promptly update this information to keep it true, accurate and complete.
you have considered acquiring comprehensive travel insurance and we are not responsible for any failure by you to acquire adequate insurance cover.
you have accessed www.dfat.gov.au and www.smarttraveller.gov.au for information specific to your intended travel destination; and
DEFINITIONS:
"We" and "us" means Baubul Pty Ltd 665 393 019 trading as Port to Peak Travel.
"You" or "your" means any user of our website or any person who acquires the Booking & Advisory Services, including any person who acquires a Travel Product (whether or not the Booking & Advisory Services were acquired by you on behalf of another person or by another person on behalf of you).
"Booking & Advisory Services" means services provided by us to you in assisting you to acquire a Travel Product from a Travel Provider and includes advisory and consulting services and facilitation of your purchase from one or more Travel Providers.
“Travel Provider” or "Travel Providers" means the company or person who provides you with the Travel Product such as airlines, tour and cruise operators, car hirers and accommodation providers. This may also include ticket consolidators and wholesalers that we use to facilitate travel with the Travel Provider.
"Travel Product" means the service or product provided by a Travel Provider, such as flights, accommodation, and ground transport.
"Website" means our website www.port2peaktravel.com.au
